These Terms and Conditions govern your use of the OnTop Rendering & Painting Services Pty Ltd (ABN 95 677 843 935) website and the provision of our services. By accessing this website or engaging our services, you agree to these terms.

We provide rendering, texture coating, wall system installation and painting services for residential and commercial properties. All work is subject to availability, a site inspection, and agreement on the scope, pricing and timing of the work.

Any advice or recommendation we provide about products, systems or finishes is given in good faith based on the information available to us at the time and the conditions observed on site.

All quotations are provided free of charge and without obligation, and are based on the information available and the site conditions observed at the time of quoting.

Quotations are valid for the period stated on them. Because rendering and painting work can reveal conditions that were not visible at the time of quoting — such as hidden damage, moisture, unsound existing coatings or substrate problems — the final price may vary from the quotation where additional work is required. Where this occurs, we will discuss it with you and agree any variation before carrying out the additional work.

Work will be carried out in accordance with the accepted quotation and any written agreement between us. Acceptance of a quotation, whether in writing, by email, or by instructing us to proceed, forms a contract on these terms together with the terms set out in the quotation.

Payment terms will be set out in your quotation or agreed with you before work begins. Any deposit, progress payment or final payment arrangements will be made clear at that time. Unless otherwise agreed, invoices are payable by the date shown on the invoice.

To allow us to carry out the work, you agree to:

• Provide accurate information about the property and the work required
• Provide safe, reasonable and timely access to the site and to power and water where needed
• Obtain any approvals, permits or body corporate consents required for the work
• Advise us of any known hazards, services or defects at the property

We will make reasonable efforts to complete the work within the estimated timeframe. Rendering and painting are weather-dependent trades, and coats must cure correctly before the next stage can proceed. Timeframes may be affected by weather, site conditions, the availability of materials, or delays caused by others, and are estimates rather than guarantees.

Our services come with guarantees that cannot be excluded under the Australian Consumer Law. Among other things, we guarantee that our services will be provided with due care and skill and will be fit for any purpose you have told us about.

Nothing in these terms limits or excludes any rights or remedies you have under the Australian Consumer Law or any other law that cannot lawfully be limited or excluded.

To the extent permitted by law, and subject to your rights under the Australian Consumer Law, we are not liable for loss or damage that is not a reasonably foreseeable result of our work, or that arises from matters outside our reasonable control — including weather, pre-existing defects or structural movement, the actions of third parties, or a failure to maintain coatings and sealants over time.

Where our liability cannot be excluded but can be limited, our liability is limited, at our option, to supplying the services again or paying the cost of having them supplied again.
